धारा 109 · Section 109

If any dispute arises [***] [Omitted 'as to the jurisdiction of a Nyaya Panchayat or' by U.P. Act No. 6 of 2017.] between two or more [Gram Panchayats] [Substituted by U.P. Act No. 9 of 1994.] or between a [Gram Panchayat] [Substituted by U.P. Act No. 9 of 1994.] and the [Nagar Panchayat] [Substituted by U.P. Act No. 9 of 1994.] or a [Municipality] [Substituted by U.P. Act No. 12 of 1994.] or a [Zila Panchayat] [Substituted by U.P. Act No. 9 of 1994.] it shall be referred to the prescribed authority whose decision shall be final and shall not be questioned in any court of law.[109A. Custody and mode of proof of records. - (1) Notwithstanding anything to the contrary contained in any other provisions of this Act, -(a)all records of a Gram Panchayat shall be in the custody of its secretary;(b)the secretary shall give to a person, on an application and on payment of such fee as may be prescribed, a copy of any such records and certify it as a true copy under his signature and seal of the Gram Panchayat.

(2)

A duly certified copy of any record of a Gram Panchayat shall be received as prima facie evidence of the existence of the record and shall be admitted as evidence of the matters therein recorded in every case, where and to the same extent as the original record would, if produced, have been admissible to prove such matters.] [Substituted by U.P. Act No. 33 of 1999.][Uttarakhand] [The word 'Uttaranchal' Substituted by Section 3 of Act No. 52 of 2006 (w.e.f. 1.1.2007).] Amendment[Section 109-A of the Principal Act shall be amended as follows :

(1)

The word 'Secretary' shall be substituted by the word 'Pradhan' in clause (a) of sub-section (1) of Section 109-A of the Principal Act.

(2)The word 'Pradhan' shall be inserted between the words 'The' and 'Secretary' in clause (b) of sub-section (1) of Section 109-A of the Principal Act.

(3)

A new clause (c) shall be inserted after clause (b) of sub-section (1) of Section 109-A of the Principal Act as follows namely :'(c) Secretary of the Gram Panchayat shall be responsible for proper maintenance and making entries in the records.'] [Vide Uttaranchal Act No. 26 of 2003.]
