Section 8 · Periods for which prospecting license, mining/quarry lease may be granted or renewed

(1)

The period for which a prospecting license may be granted shall not exceed two years.

(2)

The maximum period for which a mining lease may be granted shall not exceed thirty years:Provided that the minimum period for which any such lease may be granted shall not be less than twenty years.

(3)

A mining lease may be renewed for a period not exceeding twenty years:Provided that no such renewal shall be granted unless the lessee has a set up an industry for processing of decorative stones in the State.

(4)

Notwithstanding anything contained in Sub-rule (3), if the State Government are of the opinion that in the interest of development of decorative stones it is necessary to do so, it may, for reasons to be recorded in writing, authorize the renewal of a lease for a further period or periods not exceeding twenty years in each case.

(5)

A quarry lease may be granted for a period not exceeding five years for lessees referred to in Clauses (i), (ii) and (iii) of Sub-rule (3) of Rule 27 and three years for lessees referred to in Clauses (iv) and (v) thereof.

(6)

The quarry lease may be renewed for one or more periods. The period of each renewal shall not exceed the original grant period.

(7)

An application for renewal of mining/quarry lease shall be made at least ninety days before the expiry of lease to the Competent authority. An application for renewal of mining/quarry lease shall be disposed of before expiry of the lease term.Chapter-II Grant of Prospecting License for Decorative Stone
