धारा 37 · Notice of tramway system accident

(1)

Where in the course of working of the tramway system,-

(a)

any accident attended with loss of any human life, or with grievous hurt, as defined in the Indian Penal Code, 1860; or

(b)

any collision between any rolling stock or of any rolling stock with any vehicle or thing; or

(c)

any derailment of any rolling stock carrying passengers, or of any part thereof; or

(d)

any accident of a description usually attended with loss of human life or with such grievous hurt as aforesaid: or

(e)

any accident of any other description which the State Government may notify in this behalf:

occurs, the tramway official, in charge of the station nearest to the place of accident shall, without delay, give notice of the accident in such form and containing such particulars, as may be prescribed, to the Safety Commissioner, the Deputy Commissioner of Police, and the officer in charge of the concerned police station and to such other magistrate or police officer as may be appointed in this behalf by the State Government.

(2)

The tramway operator shall, without delay give notice of the accident to the State Government and the Safety Commissioner, who shall conduct an inquiry into such accident in the manner prescribed by rules made in this behalf.

(3)

The inquiry into such accidents, including the procedure for such enquiries, the powers of the Safety Commissioner for the purpose of conducting an inquiiy and the filing of returns upon the completion of such inquiry and powers in relation to such accidents including temporary suspension of traffic on the affected sections of the tramway system, shall be regulated by rules made in this behalf.
